**Terms and Conditions for EngraveVine**

Gumma Enterprises Inc, a Michigan-based company, operates EngraveVine.com (the "Website" or "Site"). We reserve the right to modify prices at any time without prior notice. EngraveVine retains the right to correct pricing errors, including typographical mistakes, at its sole discretion. Additionally, EngraveVine may update these terms and conditions at any time, and your continued use of the Website signifies your acceptance of such changes. If you do not agree with these terms and conditions, please refrain from using the Website. Access to the Website will be terminated automatically if you breach any of these terms and conditions and are under 21 years of age.

The section headings within these terms and conditions are provided for convenience only and do not affect the interpretation or construction of the terms. References to "including" or "include" are to be understood as "including, without limitation" or "include, without limitation," as applicable.

Shipping Policy

Inventory & Availability

Items listed as “In Stock” are either:

• Physically available in our Michigan warehouse, or
• Readily accessible through one of our trusted suppliers

In some cases, items must be sourced from our supplier at the time your order is placed. This may result in an additional 5–7 business day processing delay prior to shipment.

Because of this, EngraveVine may not be aware of vintage, packaging, or bottle design changes until the product is received at our facility.

If you expressed explicitly in the order notes at checkout that you are not willing to accept vintage or packaging changes, we will contact you prior to shipment. At that time, you may:

• Approve the updated item
• Select a comparably priced substitute
• Request a refund

If we reach out regarding a change or availability issue, your order will remain open for up to 7 business days. If we do not receive a response within that time, we will proceed under the assumption that the changes are approved and ship accordingly.

If any items become unavailable, those items will be refunded and the remainder of your order will ship as scheduled.

- Minor damage, spills, and cosmetic defects may occur during transit. EngraveVine is not liable for such minor damage.
- If a package is returned due to failed delivery, a restocking fee of 25% will be deducted from your refund. Shipping costs will not be refunded.
- If a package is returned to EngraveVine damaged due to failed delivery attempts or refusal of delivery, you are responsible for the full cost of the order.
- EngraveVine is not responsible for lost shipments, including those lost due to hold requests or delivery rescheduling.
- You must be at least 21 years old to place an order, and a signature from someone at least 21 years of age is required upon delivery.
- Customers are solely responsible for compliance with local and state laws regarding the shipment of alcohol.
- Orders placed Monday through Friday will be shipped within 1-9 business days.
- Ground shipments placed Monday through Friday before 4 p.m. PST will be shipped within 1-9 business days (processing times may be extended during the holiday season). Stock availability may affect delivery times.
- Express shipments placed Monday through Friday before 4 p.m. PST will be shipped the following business day (processing times may be extended during the holiday season). Stock availability may affect delivery times.
- Orders placed after business hours on Friday, or on Saturday or Sunday, will be shipped within 1-9 business days from the following Monday.
- Our warehouse is located in Michigan.
- We do not ship outside the U.S.
- EngraveVine does not ship to P.O. boxes.

**Purchase of Alcoholic Beverages**

- By placing an order, you confirm that you are at least 21 years old and consent to EngraveVine charging your credit card for the total amount of your order.
- You affirm that all items purchased on the Site are for personal consumption and not for resale. Sales tax will be applied as required by your State or, if applicable, Michigan sales tax. You are also responsible for any local taxes imposed by your State.
- If an item is out of stock, we will issue a refund for the portion of your order pertaining to the out-of-stock item.
- Any address change requests must be made promptly after placing an order. While EngraveVine will make reasonable efforts to accommodate address changes, we cannot guarantee such changes can be made. Any associated fees will be the customer's responsibility.
- **Title to Goods:** Ownership of goods transfers to you once your payment has been processed and received, and all holds have been cleared. Title to all alcoholic beverages passes to you in the State of Michigan when the goods are picked up by the common carrier.

**Shipping Laws**

- You are responsible for adhering to all State and local laws, rules, and regulations concerning the receipt of alcoholic beverages from out of state. You also represent that you have obtained any necessary permissions, paid any required fees, are working with properly licensed intermediaries where necessary, and are legally entitled to possess the alcoholic beverages. Additionally, you and the person accepting delivery must be at least 21 years of age.
- By purchasing on our Site, you authorize us to appoint a common carrier and arrange transportation for the delivery of alcoholic beverages and other merchandise. By using this service, you affirm that you comply with your local and State laws regarding the purchase, transportation, and delivery of alcoholic beverages. We make no representations regarding the legal requirements for shipping alcohol to your State; our Website indicates where common carriers are willing to deliver. You are responsible for ensuring compliance with all applicable laws and agree to indemnify and hold harmless EngraveVine and its affiliates from any claims, damages, or liabilities arising from the shipment of alcoholic beverages.

**Change in Shipping Laws**

- Should State laws change after your order is placed but before shipment, making it illegal to import alcoholic beverages into your State, you may return the order for a full refund, provided you submit proof of the regulatory changes. Returns must comply with Michigan law; returns across state lines are not permitted. Once an order has shipped, title to the goods passes to you and no refunds will be issued.

**Shipment Method, Timing, and Delivery**

- Products are shipped from our Michigan warehouse. EngraveVine aims to fulfill orders promptly; however, please allow 8-10 days for delivery. Shipping charges are based on weight, destination, and delivery method.
- Deliveries require a signature from an adult over the age of 21. No deliveries will be left without this signature. Inspect your order immediately upon delivery and report any discrepancies within three (3) business days.
- If an incorrect item is shipped, please email a photo of the sealed bottle along with your receipt or order number to EngraveVine. If you do not receive a response within 14 days, resend the email from an alternative address if possible.

**Failed Delivery Attempts**

- If you do not receive your order after the maximum number of delivery attempts by the shipping agency and the package is returned to EngraveVine, a 25% restocking fee will be deducted from your refund. Shipping and engraving costs will not be refunded. For items initially shipped free due to promotions, $40 will be deducted for shipping and handling. If the package is returned damaged due to failed delivery attempts or refusal of delivery, you are responsible for the full cost of the order.

**Damaged Items**

- EngraveVine ensures careful packaging to protect your order. However, during extreme weather conditions, you are responsible for notifying us of any special requests to delay or hold your order.

**Limitation of Liability**

- EngraveVine is not liable for any incidental, consequential, indirect, special, or punitive damages arising from your use of the Website, regardless of whether such damages were foreseeable. EngraveVine reserves the right to update any information on the Website at its sole discretion. If you disagree with any terms or content on the Website, discontinue use. The extent of EngraveVine's liability is limited to the value of your order.

**Disclaimer of Warranties**

- Although we strive for accuracy, inadvertent errors may occur. EngraveVine disclaims all liability for such errors and provides the Website "AS IS," without any warranties, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

**Force Majeure**

- EngraveVine will not be deemed in default or liable for any delays, failures in performance, or interruptions caused by events beyond its reasonable control, such as natural disasters, civil disturbances, wars, strikes, fires, or other unforeseeable occurrences.

**Final Sale and Cancellation**

- All sales are final. Orders that have not yet been packaged or shipped may be canceled at our discretion, with a possible 10% restocking fee applied. Engraved products will incur a $40 reshipping fee for returns or exchanges.

**Legality and Validity**

• If any provision of these terms and conditions is held to be invalid, illegal, or unenforceable by a court, the remaining provisions shall remain in full force and effect. The parties will work to fulfill the intent of the invalidated provision to the extent permitted by law.

**TRANSFER OF OWNERSHIP & LEGAL DISCLAIMER**

EngraveVine, as a business, does not ship wine or spirits directly. However, we are happy to facilitate the coordination of shipment for your order by engaging a third-party common carrier on your behalf. By authorizing the shipment, you allow EngraveVine to arrange for a third-party carrier to deliver the product to you.

Title for all products pass to the buyer at the time of purchase. If you request shipment of your product, you authorize EngraveVine to engage a common carrier to deliver the product on your behalf. If you choose to ship your purchase to a state where alcohol shipping laws are restrictive or non-reciprocal, you assume full responsibility for complying with your state’s regulations regarding alcohol shipments.

You must be at least 21 years of age to order or receive alcoholic beverages from EngraveVine. All shipments containing alcoholic beverages will include an “Adult Signature Required” notice, and the carrier is required to verify identification and age upon delivery. Therefore, you must be present at the time of delivery to receive the package.

Please be aware that various states have restrictions on the amount of alcohol that can be purchased and transported across state lines without specific licenses or permits. EngraveVine does not assume responsibility for obtaining any permits or licenses for these shipments. It is your responsibility to research and comply with the regulations in your state and to ensure any applicable excise, use, or sales taxes related to your purchase are paid.

EngraveVine makes no legal representation regarding the rights to ship or import alcohol into any state. The buyer is solely responsible for the shipment of wine or spirits and for any loss or damage once the product leaves our premises. By placing an order, you authorize EngraveVine to act on your behalf to arrange delivery through a third-party carrier.
